During divorce proceedings, whether in the Magistrate’s Court, or High Court, there are remedies to the above problems.
Rule 43 proceedings (in the High Court), and Rule 58 proceedings (in the Magistrate’s Court), are quick, and cost effective applications that can be brought – while awaiting the finalisation of the actual divorce – in order to obtain the following relief:
- Maintenance for yourself;
- Maintenance for your minor children;
- A contribution towards your legal costs;
- An interim arrangement regarding visitation rights with your minor children;
More often than not, parties to divorce proceedings are unaware of their rights, and unaware that there are procedures in place in order to effectively obtain, or enforce these rights.
